Mike Pearson examines a federal lawsuit filed in Cedar Rapids, Iowa by CTM Holdings LLC against the 40-year old Sodbuster Rule.
CTM Holdings, LLC owns 1,000 acres in Iowa. The land involved in the lawsuit involves the 71-acre family farm. On the farm is a seven acre piece, that isn't wet or considered close to a wetland but is considered impractical to cultivate due to the wetland area and the Sodbuster Rule.
The lawsuit was filed against the rule argues the constitution does not allow the federal government to regulate land.
The constitution contends the federal government can't withhold funding from the USDA in exchange for land regulation.
The lawsuit seeks unspecified damages and the law declared unconstitutional.
